Terms of Use – True Joy Birthing

These Terms of Use (“Terms”) are a legal agreement between you and True Joy Birthing (“True Joy Birthing,” “we,” “us,” or “our”). They govern your use of our website at truejoybirthing.com and our mobile applications, including the True Joy Birthing app for moms, doulas, and midwives (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who may use the Services

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement.

The Services are intended for users located in the United States.

2. No medical advice

True Joy Birthing offers educational content and organizational tools to help you prepare for pregnancy, birth, and postpartum, and to help doulas and midwives manage their work. We do not provide medical care or medical advice. Nothing in the Services should be treated as a diagnosis, treatment, or individualized medical recommendation.

Always talk to your licensed healthcare provider (such as your doctor or midwife) about any questions or concerns regarding your health, pregnancy, birth, or postpartum care. Do not ignore or delay seeking professional medical advice because of something you have read or seen in the Services. If you think you may be experiencing an emergency, call 911 or your local emergency number immediately.

3. Your account and responsibilities

To use some features, you may need to create an account and choose a password. You are responsible for:

  • Keeping your login details confidential.
  • All activity that happens under your account.
  • Providing accurate information and keeping it up to date.

If you believe your account has been compromised, please contact us right away at shelbi@truejoybirthing.com.

If you are a doula or midwife, you are responsible for using the Services in a way that is consistent with your professional obligations and any applicable privacy or record‑keeping laws that apply to you.

4. Acceptable use

You agree not to use the Services in any way that:

  • Violates any law or regulation.
  • Harasses, threatens, or harms others.
  • Attempts to access accounts or data that are not yours.
  • Uploads or shares content that is illegal, offensive, or infringes someone else’s rights.
  • Tries to disrupt or interfere with the security or proper functioning of the Services.

We may, at our discretion, suspend or terminate your access to the Services if we believe you have violated these Terms or are otherwise using the Services in an inappropriate or unsafe way.

5. User content

The Services allow you to add information, such as birth plans, notes, messages, visit details, contracts, and invoices (“User Content”). You remain the owner of your User Content, but you give us a limited license to use it only as needed to operate and improve the Services.

By adding User Content, you confirm that:

  • You have the right to share it.
  • It does not violate any law or someone else’s rights.
  • If it includes information about another person (for example, a client), you are allowed to share that information through the Services.

We may remove User Content that we believe violates these Terms or applicable law.

6. Subscriptions and payments

Moms and birthing parents can use the app for free. Pro features for doulas and midwives are offered as paid subscriptions.

In the mobile apps, subscriptions are billed through Apple’s App Store and Google Play. On the website, certain purchases may be processed through Stripe or another payment provider. All payments, renewals, and cancellations are handled according to the terms and policies of the applicable store or payment provider.

You are responsible for reviewing those terms and for managing your subscription or payment settings directly with Apple, Google, or Stripe as applicable.

7. Intellectual property

The Services and all content we provide (including text, graphics, logos, icons, and software) are owned by True Joy Birthing or our licensors and are protected by copyright and other laws. We grant you a personal, limited, non‑exclusive, non‑transferable license to use the Services for your own personal or professional use in connection with birth support, subject to these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Services, nor reverse‑engineer or attempt to extract the source code, unless laws prohibit these restrictions or you have our written permission.

8. Third‑party services and links

The Services may include links to third‑party websites or services (such as payment providers, educational resources, or partner tools). These third parties are responsible for their own content and privacy practices. We are not responsible for, and do not endorse, any third‑party websites or services. We encourage you to review their terms and privacy policies before using them.

9. No warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error‑free, or that any information provided is complete or up to date.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

10. Limitation of liability

To the fullest extent permitted by law, True Joy Birthing and our owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of (or inability to use) the Services.

Our total liability for any claim arising out of or relating to the Services will not exceed the amount you have paid to us for the Services in the six (6) months preceding the event giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnity

You agree to indemnify and hold True Joy Birthing and our owners, employees, and partners harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another person.

12. Changes to the Services and these Terms

We may update or change the Services at any time, including adding or removing features. We may also update these Terms from time to time. When we do, we will change the “Last updated” date above. If we make material changes, we may notify you (for example, by email or a notice in the app). Your continued use of the Services after any changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of [choose state, for example: Utah], without regard to its conflict of law principles. Any disputes arising under or relating to these Terms or the Services will be resolved in the state or federal courts located in [same state], and you consent to the jurisdiction of those courts.
